By viewing our website, you agree that the Law of the State of California in San Diego County will be sole venue and jurisdiction of any regulations pertaining to any use of our website, products and copyright policies. If we cannot amicably resolve any disputes that arise, the above legal entity will hold jurisdiction. You agree that any disputes or claims resulting from use of product, between you, your pet and any employees or TSPB purchased hereunder shall be resolved exclusively as determined by submission to arbitration as provided by California law, and not by a lawsuit or resort to court process except as California Law provides for judicial review of the arbitration proceedings. Both you and TSPB, by entering into it are giving up their constitutional rights to have such dispute decided in a court of law before a jury, and instead are accepting the use of arbitration.

All claims for monetary damages exceeding the jurisdictional limit of the small claims court in California against TSPB, and all employees or partners, must be arbitrated, including, without limitation, claims for loss of consortium, wrongful death, emotional distress or punitive damages. Arbitration process: A demand for arbitration must be communicated in writing to the involved parties. Each party shall select an arbitrator, and a third neutral arbitrator shall be selected by the arbitrators appointed. Each party of the arbitrator shall pay such party's pro rata share of the expenses and fees of the neutral arbitrator, with the expenses of the arbitration incurred or approved by the neutral arbitrator, not including counsel fees or witness fees, or any other expense incurred by a party. Any award of the arbitrator shall be final and binding on all parties and may be entered as judgment in any court of jurisdiction. Each party will pay its own costs associated with this arbitration, including but not limited to attorney fees, arbitration fees, and any fees required to obtain a hearing. By visiting TSPB website, and submitting and checking out, you agree to all our terms and agreements and you agree by contract to have any issues associated with TSPB decided by neutral arbitration and you are giving up your right to a jury or court trial.

FRAUDULENT ACTIVITIES CONDUCTED IN OUR STORE:
If you conduct any fraudulent activity on our website, in any way related to our business, including but not limited to credit card fraud, we WILL prosecute you.  Please note that we have employed sophisticated software to detect fraudulent and unauthorized activities.

Credit Card Charge back:
TSPB has a zero tolerance policy for activities in which you make purchases and conduct a dispute with your credit card company of such charges (charge-back) which will be considered fraudulent activities. Such issues will include but not limited to cardholder did not authorize transaction, non-matching account number, cardholder never received merchandise/service, card not used within valid expiration date, error in transaction amount, different product from what was described or promised, counterfeit transaction, failure to obtain cardholder signature. In such cases, TSPB will immediately terminate your account, block you from further use of our website and business, notify your credit card company of such fraudulent activities, and take any other corrective action TSPB deems necessary.

Pricing, product content and description, availability of products:
We do our best to accurately list product price and description. The price and product description can and will be changed at any given time as deemed fit by TSPB. Inventory levels can and will change at any given time. We will in our best efforts make sure our website pricing, product description and availabilities of products are accurate and current but if any inaccuracies exist, you agree that by viewing our website, you will not hold TSPB liable for any changes at any given time.  Despite TSPBs best efforts, if merchandise is mis-priced and if the merchandise's correct price is higher than the stated price on our website, we will, at our discretion, either contact the purchaser for instructions before shipping or cancel the order with notification. When you place your order by clicking on the 'submit' button, you will receive an e-mail to acknowledging receipt of your order.  Your contract to purchase these items will not be complete until you receive another e-mail from TSPB notifying you your order has been shipped.  TSPB reserves the right to cancel any orders.

Product Warranties:
You will not hold any product warranties you see or purchase from the TSPB.  We do not warranty any product functionality or quality. Any issues arising from such will be take upon the manufacturer of the product.  We do not warranty such expressed or implicated functionality of any products and are thus not responsible for any harm caused by any products or service provided or any content on our website.  By visiting our website and purchasing our products, you agree to abide by these policies. Any warranties will be taken upon the manufacturer, TSPB will not have any involvement of such cases.  In no event will any of TSPB employees or company will be held liable for any damage caused by your use of our website or any given products.  In the event any product causes you, your family, or your pet any harm, you agree not to hold TSPB harmful or responsible for such damage.  Any such claims will be take up with the manufacturer.  You purchase all items at your own risk.
